1. Scope and contracting party

These General Terms and Conditions apply to all accommodation contracts for the apartments “Arch” and “Chevron”, Hannovergasse, 1200 Vienna, concluded via ortdeco.at or directly with us. The contracting party is Elisabeth Ortmayr, Wimmergasse 14, 4203 Altenberg bei Linz, Austria (the “Host”). For bookings via external platforms (e.g. Airbnb), their respective terms apply in addition.

The Austrian General Terms and Conditions for the Hotel Industry (AGBH), as amended, apply supplementarily where these terms do not provide otherwise.

2. Conclusion of contract

Enquiries and bookings via the website constitute an offer by the guest. The accommodation contract is concluded only upon our written booking confirmation (e-mail). For bookings on request, we reserve the right to accept within 24 hours.

The guest must provide complete and accurate information, in particular the number and full names of accompanying guests. The booked number of guests may not be exceeded; maximum occupancy is 4 persons per apartment.

3. Prices and payment

The prices displayed at the time of booking apply, stated in euros. The total price includes the stay for the booked number of guests, Vienna city tax, and the one-time cleaning fee. Any additional charges for extra guests are clearly shown during booking.

The total price is due immediately upon booking and is processed securely via Stripe by credit card or other offered payment methods. The booking is confirmed only upon receipt of full payment.

The Host is exempt from VAT under the Austrian small business scheme (§ 6(1)(27) UStG); prices are therefore stated without VAT.

4. Cancellation by the guest, no-show

Two rates are available at the time of booking. The selected rate is specified in your booking confirmation.

Flexible rate:
a) For cancellations up to 30 days before the arrival date, the full booking price will be refunded. If booked less than 30 days before arrival, a full refund applies to cancellations within 48 hours of booking, provided they are made at least 14 days before arrival.
b) For cancellations between 30 and 7 days before arrival, 50% of the accommodation price will be refunded.
c) For cancellations less than 7 days before arrival, after arrival, or in case of no-show, no refund of the accommodation price will be issued.

Non-refundable rate: Offered at a 10% discount compared to the flexible rate. In case of cancellation or no-show, no refund of the accommodation price is due, regardless of timing.

City tax and the cleaning fee will always be refunded for unused nights. Cancellations must be made in writing (via e-mail to welcome@ortdeco.at); the time of receipt by us is decisive.

Note: Accommodation contracts with a fixed period of performance are exempt from the statutory right of withdrawal under the Austrian Distance Selling Act (§ 18(1)(10) FAGG).

5. Withdrawal by the Host

The Host may withdraw from the contract if performance becomes impossible due to unforeseen circumstances beyond our control (e.g. force majeure, official orders, severe damage to the property), if false information was provided by the guest, or if there is legitimate reason to believe that the apartment's use would breach the house rules (e.g. unauthorized parties, over-occupancy). Any payments made will be fully refunded; further claims are excluded unless caused by intent or gross negligence on the part of the Host.

6. Arrival, departure, self-check-in, registration

The apartment is available from 3:00 PM on arrival day and must be vacated by 11:00 AM on departure day. Access is handled via self-check-in using an electronic smart lock; your personal code will be sent prior to arrival and must not be shared with third parties.

Under the Austrian Registration Act, every guest must complete online pre-registration, including providing valid travel document details. Without completed online registration, the digital access code cannot be released.

For unauthorized late departures without prior agreement, a fee equivalent to one additional night may be charged.

7. Use of the apartment, house rules

The apartment is reserved exclusively for residential and recreational purposes by registered guests. The house rules published online and displayed in the apartment apply at all times—specifically: no parties or events, strict non-smoking policy, quiet hours from 10:00 PM to 7:00 AM, no pets without prior written consent, and careful treatment of all inventory.

In the event of severe or repeated violations, the Host reserves the right to terminate the contract with immediate effect without a refund for remaining nights.

8. Liability, damage

Guests are fully liable for any damage caused to the apartment, its furnishings, or the building by themselves or accompanying visitors. Damage must be reported immediately. The Host reserves the right to invoice guests for damages discovered after departure or utilize pre-authorized payment mechanisms where applicable.

The Host is liable for material or financial damage only in cases of proven intent or gross negligence; liability for personal injury remains untouched. No liability is assumed for personal valuables brought into the property, to the extent permitted by law. Temporary utility interruptions (electricity, water, internet) outside the Host's control do not give rise to claims for price reductions.

9. Data protection

Details regarding the processing of personal data related to your booking, payments, online check-in, and stay are outlined in our privacy policy available at ortdeco.at.

10. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing within the EU, mandatory consumer protection rules of their home country apply where applicable; otherwise, the competent court in Vienna holds jurisdiction.

Should individual provisions of these terms be found invalid, the remaining provisions remain fully effective. The German version of these terms serves as the legally binding master text; the English version is offered purely for convenience.

2. Principles

We process personal data strictly in line with the GDPR, the Austrian Data Protection Act (DSG), and the Telecommunications Act (TKG 2021), collecting only what is necessary to run this website, process bookings, and adhere to legal mandates.

3. Website operation, hosting, and server logs

Our website and booking system are hosted via Smoobu GmbH, Berlin, Germany. Technical data such as your IP address, timestamps, requested pages, browser specs, and referrer URLs are automatically recorded in server logs to ensure secure and stable operation.

Legal basis: Legitimate interest (Art. 6(1)(f) GDPR). Retention period: Typically deleted within 14 days.

4. Cookies

Essential cookies required for core site functionality (language settings, booking sessions, security) are deployed pursuant to § 165(3) TKG 2021 and legitimate interest (Art. 6(1)(f) GDPR). Optional analytics or tracking cookies are set only upon active consent via our cookie banner (Art. 6(1)(a) GDPR), which can be managed or revoked at any time.

5. Enquiries and bookings

When inquiring or booking through our platform, we collect identifiers including your name, address, e-mail, phone number, stay duration, guest details, and preferences. Data processing is managed through Smoobu GmbH as our processor.

Purpose: Contract fulfillment, pre-contractual support, communication, and accounting. Legal basis: Contract execution (Art. 6(1)(b) GDPR) and legal retention obligations (Art. 6(1)(c) GDPR). Retention: Duration of contract plus statutory commercial periods (7 years).

6. Payment processing

Direct payments are handled via Stripe Payments Europe Ltd., Dublin, Ireland. Card data is collected directly by Stripe; we receive only transaction references and clearance notifications. Stripe acts as an independent controller (stripe.com/privacy). International transfers rely on the EU-US Data Privacy Framework.

Legal basis: Contract performance (Art. 6(1)(b) GDPR). Records are kept for 7 years.

7. Online check-in, ID data and guest register

Under the Austrian Registration Act (§§ 5, 10 MeldeG), we must maintain an official guest registry. Our digital check-in collects full names, dates of birth, nationality, ID card details, addresses, travel dates, and electronic signatures via Chekin (Chekin App S.L., Seville, Spain). Document images are used strictly for identity validation and registry data entry.

Legal basis: Statutory obligation (Art. 6(1)(c) GDPR in conjunction with MeldeG). Retention: 7 years. Completion is mandatory for stay authorization.

8. City tax and tourism statistics

Monthly reports summarizing arrival metrics, overnights, and guest countries of origin are submitted to the City of Vienna in aggregated, non-personally identifiable formats to satisfy regional tourism regulations.

9. Communication

Inquiries via e-mail, phone, or messaging platforms are processed to handle your requests. Operational booking notices (confirmations, smart lock instructions) are sent automatically via Smoobu.

10. Electronic access system (smart lock)

Property access utilizes Nuki smart locks (Nuki Home Solutions GmbH, Graz, Austria). Unique, time-bound access keys are generated per reservation. Access logs are kept for security and automatically purged after a maximum of 90 days.

11. Booking platforms

For external channel bookings (e.g., Airbnb, Vrbo), platform privacy policies govern data handling on their end. We only ingest necessary reservation details to manage fulfillment.

12. Embedded third-party services

Google Maps: Used to display property coordinates (Google Ireland Limited). IP transmission occurs upon loading maps. Privacy policy: policies.google.com/privacy.
Google Fonts: Integrated locally or via secure content delivery to ensure aesthetic font consistency.

13. Recipients and processors

Processors (Art. 28 GDPR): Smoobu GmbH, Chekin App S.L., Nuki Home Solutions GmbH, hosting providers, and tax consultants. Independent entities: Stripe and public authorities.

14. Transfers to third countries

Data transfers outside the EEA occur strictly under adequacy frameworks (EU-US Data Privacy Framework) or standard contractual safeguards.

15. Retention periods

Registry logs: 7 years. Tax/billing records: 7 years. Server logs: max 14 days. Smart lock logs: max 90 days. General inquiries: 6 months.

16. Your rights

You hold rights to access (Art. 15), correction (Art. 16), deletion (Art. 17), restriction (Art. 18), portability (Art. 20), and objection (Art. 21 GDPR). Requests can be directed to office@ortdeco.at. Supervisory complaints may be filed with the Austrian Data Protection Authority (dsb.gv.at).

17. Data security

All data streams are secured using modern TLS/SSL encryption alongside technical safeguards implemented by us and our processing partners.

18. Changes to this policy
